Welcome to TinyCribs.co.za (“TinyCribs”, “we”, “us”, or “our”). By accessing or using our website, directory, and related services (collectively, the “Platform”), you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before using the Platform.

1. About the Platform

  • Directory Model: TinyCribs operates strictly as an online listing and classified directory connecting property owners, managers, and consumers (“Users”) with independent contractors, tradespeople, and service providers (“Service Providers”).
  • No Brokerage or Agency: TinyCribs is not a contracting agency, marketplace broker, party to any service contract, or employer of any Service Provider. Any agreement, job scope, pricing, or transaction entered into between a User and a Service Provider is strictly between those two parties.

2. Directory Listings & Subscriptions (For Service Providers)

  • Account & Profile Creation: Service Providers must supply accurate, current, and complete business information when creating or claiming a profile.
  • Paid Plans & Advertising: Selected listing tiers, featured placements, or promotional placements may require paid subscription fees. Fees are non-refundable once the listing period has commenced, unless required by South African law.
  • Contact & Inquiries: All client inquiries generated through TinyCribs.co.za are routed directly to the Service Provider. TinyCribs.co.za charges ZERO COMMISSION on jobs booked through direct contact details listed on profiles.

3. User Conduct & Listing Content

  • Accuracy of Information: Service Providers are solely responsible for ensuring that all uploaded images, descriptions, contact numbers, licenses, and business details are accurate, lawful, and up to date.
  • Prohibited Content: You may not post material that:
    • Is fraudulent, misleading, or deceptive.
    • Infringes on third-party intellectual property or privacy rights.
    • Promotes unlawful services or activities under South African law.
  • Content Moderation: TinyCribs.co.za reserves the right to review, edit, suspend, or permanently remove any listing, profile, or account that violates these Terms or receives validated complaints, without prior notice or liability.

4. Disclaimers & Limitation of Liability

  • Independent Contractors: TinyCribs.co.za does not guarantee the quality, safety, legality, timing, or performance of any services offered or provided by listed Service Providers.
  • No Endorsement: The inclusion of a Service Provider on TinyCribs.co.za does not constitute an official endorsement, warranty, or guarantee of their work or licensing status.
  • Direct Transactions: Users are solely responsible for conducting their own due diligence, verifying trade qualifications, requesting references, and agreeing on payment terms before engaging any Service Provider.
  • Limitation of Liability: To the maximum extent permitted by the laws of South Africa (including the Consumer Protection Act 68 of 2008), TinyCribs.co.za shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Platform or your engagement with any Service Provider or User.

5. Intellectual Property

  • All website layout, software, design elements, graphics, logos, and original content on TinyCribs.co.za belong exclusively to TinyCribs.co.za.
  • Users and Service Providers retain ownership of their submitted text and images, but grant TinyCribs.co.za a royalty-free, worldwide license to display and promote that content on the Platform and associated marketing channels.

6. Protection of Personal Information (POPIA)

  • TinyCribs.co.za processes personal data in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).
  • By submitting personal or business contact details, you consent to TinyCribs.co.za displaying this information publicly on the directory for the purpose of facilitating business inquiries.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts.
